Coupsy Terms of Service

1. Use of the Service
1.1 The Service provides users with the capacity to generate coupon codes, transmit such codes to external systems, and perform other functions Coupsy may elect to enable, remove, or modify without prior notice, obligation, or liability.
1.2 Coupsy reserves the unrestricted right to alter, discontinue, suspend, limit, or otherwise interfere with any portion of the Service, its interface, or functionality, temporarily or permanently, with or without notification, and shall bear no duty or liability whatsoever for any damages or inconvenience thereby resulting.
1.3 Use of the Service is provided as-is, with all faults, and without warranties of any kind, whether express, implied, or statutory, including, without limitation, warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
2. Free Tier and Payments
2.1 The Service may offer a free tier or usage-based access. Coupsy reserves the right to modify, restrict, terminate, or otherwise interfere with free-tier access at any time and for any reason.
2.2 No refunds will be issued under any circumstances, regardless of perceived functionality, system availability, feature access, user satisfaction, or any other basis.
3. Limitation of Liability
3.1 To the maximum extent permissible under applicable law, Coupsy, its directors, officers, affiliates, contractors, licensors, and employees shall not be liable for any direct, indirect, incidental, consequential, punitive, or exemplary damages (including but not limited to loss of profits, loss of data, or interruption of business) arising out of or relating to use of the Service, even if advised of the possibility of such damages.
3.2 The User expressly acknowledges that reliance upon the Service for any commercial or mission-critical purposes shall be undertaken solely at the User's own risk.
4. Data Collection, Storage, and Use
4.1 User data, including but not limited to email addresses, usage behavior, and end-customer information (including personally identifiable data such as names, emails, and purchase history) may be collected, stored, and transmitted to Coupsy's systems for operational, analytical, advertising, marketing, and business development purposes.
4.2 The User grants Coupsy irrevocable, perpetual, worldwide, royalty-free rights to use such data for any internal or commercial purpose, including but not limited to targeted marketing campaigns, third-party data exchanges, product development, and algorithmic training.
5. User Responsibilities
5.1 Users shall remain solely responsible for the legality, accuracy, and appropriateness of any data they transmit, whether directly or indirectly, to or through the Service.
5.2 The User affirms that they shall comply with all applicable local, national, and international laws when using the Service and shall indemnify Coupsy from any liability resulting from the User's use or misuse thereof.
6. Modifications to the Agreement
6.1 Coupsy may revise, amend, restate, or entirely rewrite this Agreement at any time without prior notice. Continued use of the Service following such changes constitutes full acceptance of the revised terms.
7. Termination
7.1 Coupsy may, in its sole and unappealable discretion, terminate or suspend the User's access to the Service at any time, without notice, justification, or obligation of explanation.
8. Governing Law and Jurisdiction
8.1 This Agreement shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict-of-law provisions.
8.2 Any legal action, arbitration, or other proceedings arising out of or relating to this Agreement or the Service shall be exclusively conducted within the jurisdiction of Estonian courts. The User irrevocably consents to such exclusive jurisdiction.
9. Waiver of Class Actions
9.1 The User agrees that all claims must be brought in the User's individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The User hereby waives any right to participate in class action lawsuits or class-wide arbitration.
10. Miscellaneous
10.1 If any provision herein is held to be unenforceable, such unenforceability shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
10.2 Failure by Coupsy to enforce any provision of this Agreement shall not be construed as a waiver of future enforcement of that or any other provision.
